| | | Le ultime novità a seguito dellentrata in vigore dei decreti del ministero della sanità 15/09/2000 e 30/10/2000. Roccandrea Iascone | | | | | | Cinque date scandiscono levoluzione della disciplina della classificazione ed etichettatura delle sostanze e preparati pericolosi: Febbraio 1997, attraverso il DL 3/2/97, n. 52, Attuazione della direttiva 92/32/CEE concernente la classificazione, imballaggio ed etichettatura delle sostanze pericolose, lItalia recepisce in una sola volta tutta la normativa comunitaria su questo argomento, costituendo per le sostanze una sorta di testo unico, abrogando nel contempo la precedente normativa. Aprile 1997 in attuazione del art. 37, commi 1 e 2, del decreto sopracitato, viene emanato dal Ministero della sanità il DM 28/04/97, contenente nellAllegato VI i requisiti generali per la classificazione e letichettatura di sostanze e preparati pericolosi. Nel 2000 lo stesso soggetto vara il DM 10/04/00 che, attraverso lallegato 4, modifica alcune parti dellAllegato VI al DM 28/04/97. Sempre nel 2000 viene emanato il DM 15/09/00, il cui Allegato sostituisce lAllegato 4 sopra citato. Infine il 30 ottobre 2000 viene licenziato il DM 30/10/00 che, oltre a modificare il titolo del DM 10/04/00, sostituisce alcune voci al relativo Allegato 1/B. Ma quali sono i motivi che hanno indotto il legislatore a operare tali modifiche e cosa è cambiato a seguito di ciò? Modifiche sostanziali LAllegato al decreto del Ministero della sanità 15 settembre 2000 (dora in poi chiamato per brevità semplicemente Allegato), sostituisce lAllegato 4 al decreto 10 aprile 2000 (dora in poi chiamato per brevità semplicemente Allegato 4). Questultimo decreto, avendo recepito le direttive 98/73/CE e 98/98/CE recanti rispettivamente il ventiquattresimo e il venticinquesimo adeguamento della direttiva 67/548/CEE del Consiglio concernente il ravvicinamento delle disposizioni legislative, regolamentari e amministrative relative alla classificazione, imballaggio ed etichettatura delle sostanze pericolose, disciplinate dal decreto ministeriale 28 aprile 1997, ha introdotto in esso numerose e importanti modifiche. Tra queste ricordiamo, ad esempio nellAllegato I, la sostituzione del testo della prefazione al decreto nonché la sostituzione e la soppressione di alcune voci, con lintroduzione di nuove, nellelenco delle sostanze pericolose. Ma la modifica più interessante per il mondo del packaging - e che merita un adeguato approfondimento - riguarda quella relativa allAllegato VI (sempre del DM 28/04/97, dora in poi chiamato per brevità semplicemente Allegato VI), disciplinante i requisiti generali per la classificazione e letichettatura di sostanze e preparati pericolosi. Per amore di chiarezza, precisiamo che, con la dicitura sostanze sintendono gli elementi chimici e i loro composti, allo stato naturale o ottenuti mediante qualsiasi procedimento di produzione, compresi gli additivi necessari per mantenere la stabilità dei prodotti e le impurità derivati dal procedimento impiegato, escluso i solventi, che possono essere eliminati senza incidere sulla stabilità delle sostanze e senza modificare la loro composizione. Col termine preparati invece ci si riferisce a miscele o soluzioni costituite da due o più sostanze (definizioni estrapolate dallart. 2 del DL 3 febbraio 1997, n. 52). Il Legislatore del DM 10/04/2000 ha modificato tale Allegato VI nei seguenti punti: - 3.2.3. nocivo; - 3.2.8. altre proprietà tossicologiche; - 6.2. frasi relative ai consigli di prudenza per sostanze e preparati; - 8 casi particolari: sostanze. Si tratta di modifiche che però, alla luce dei nuovi e ripetuti test che consentono alla Commissione di classificare le sostanze pericolose, non risultano più attuali. Tali risultati hanno quindi indotto lo stesso organo Comunitario a emanare una decisione - la 2000/368/CE del 19 maggio 2000 e recepita dallItalia con il DM 15/09/2000 - che rettificasse la vigente disciplina adeguandola agli ultimi progressi tecnici relativi alla classificazione, imballaggio ed etichettatura delle sostanze pericolose (schema 1). Vecchio e nuovo a confronto Dei quattro punti sopracitati quello degno di maggior approfondimento (e che merita unanalisi delle differenze che affiorano se si va a confrontare la vecchia disciplina dellAllegato VI con la nuova dellAllegato), è sicuramente il punto 6.2. relativo alle Frasi relative ai consigli di prudenza per le sostanze e i preparati. Va subito detto che, rispetto a quello che lo ha preceduto, il nuovo testo presenta due frasi in più: - in caso dincidente per inalazione, bisogna portare il soggetto allaria aperta e tenerlo a riposo (S 63); - in caso di ingestione, bisogna lavare la bocca soltanto se la persona è cosciente (S 64). Il punto 6.2 elenca i consigli di prudenza, che descrivono le più comuni procedure di sicurezza da adottare per minimizzare i rischi associati allimpiego della sostanza. Sono riportati sulletichetta e sulle schede di sicurezza dei prodotti attraverso Frasi tipo, ciascuna contrassegnata dalla lettera S seguita da un numero. Nei confronti di questi consigli di prudenza risultano talune variazioni, alcune solo formali altre sostanziali, relative sia ai loro campi dapplicazione (sezione che indica a quali sostanze e preparati va applicato il consiglio di prudenza), sia ai criteri dimpiego (sezione che indica in quale contesto, di tempo, luogo ed uso, le sostanze e preparati devono presentare in etichetta il consiglio di prudenza). Tutto in etichetta E proprio a proposito dei criteri dimpiego, la sostituzione sistematica della frase ... sostanze e preparati in vendita al dettaglio... con ... sostanze e preparati in vendita al pubblico..., per indicare dove e quando la frase contenente il consiglio di prudenza deve essere obbligatoriamente presente nelletichetta della sostanza o preparato pericoloso, farebbe pensare allintenzione del legislatore di individuare tale contesto non solo, come precedentemente disciplinato dallAllegato VI, nel canale della vendita al consumatore finale, ma anche in altri (ad esempio quello della distribuzione allingrosso o alle comunità). Le frasi interessate da questa modifica sono quelle contrassegnate dalla sigla S1 e S2 (schema 2). Inoltre, sempre in riferimento a come le frasi contenenti i consigli di prudenza devono essere impiegate nelletichetta della sostanza o preparato pericoloso, in quelle contraddistinte dal simbolo S13, S18, S20, S29, S33, S46, S50, S51, S56, S57 viene preferita quella che fa riferimento ... alluso corrente... delle stesse (schema 3), rispetto alla logica che imponeva la loro presenza in tutte le sostanze e preparati ... in vendita al dettaglio.... Consigli di prudenza più estesi Analizzando invece le modifiche al campo dapplicazione delle frasi relative ai consigli di prudenza per sostanze e preparati, è necessario segnalare che la frase S45 verrà applicata a sostanze e preparati che, oltre a essere altamente tossici, tossici e corrosivi, provocano sensibilizzazione se inalati. Le frasi S56, S59, S60 saranno applicate a tutte le sostanze e preparati pericolosi e non solo, come invece disciplinato dallAllegato VI, esclusivamente alle sostanze pericolose per lambiente. Infine, ulteriori modifiche sostanziali relative tanto allimpiego quanto allapplicazione, sono riportate anche nelle seguenti frasi: - S25, la cui applicazione non è più solo circoscritta a sostanze e preparati corrosivi o irritanti, ma anche pericolosi per la salute; - S27, il cui impiego diventa obbligatorio per le sostanze e i preparati altamente tossici di uso corrente (cui è stata assegnata la frase R 27), mentre è raccomandabile sia per i medesimi destinati a usi industriali sia per quelli tossici (cui è stata assegnata la frase R 24) e, infine, per quelli corrosivi di uso corrente); - S28, di cui viene raccomandato limpiego anche per sostanze e preparati corrosivi di uso corrente; - S29, la cui applicazione oltre che per i liquidi estremamente o facilmente infiammabili non miscibili in acqua, è ora prevista anche per le sostanze pericolose per lambiente e le sostanze e preparati altamente tossici e tossici; - S35, la cui applicazione viene ora estesa a tutte le sostanze e preparati pericolosi, mentre se ne raccomanda limpiego per quelle sostanze e preparati che necessitano di istruzioni particolari per garantirne il corretto smaltimento; - S37, applicabile anche a sostanze e preparati che provocano sensibilizzazione a contatto con la pelle; - S 62, il cui impiego, oltre a essere raccomandato per sostanze e preparati nocivi caratterizzati dalla frase R 65 se usati nellindustria, diventa invece obbligatorio quando gli stessi prodotti sono venduti al pubblico o sono di uso corrente (salvo se sono obbligatorie le frasi S 45 e S 46). Per quel che riguarda infine lultimo decreto, in ordine di tempo, emanato dal Ministero della sanità (DM 30 ottobre 2000), bisogna rilevare due tipi di intervento sul DM 10/04/00. Il primo è prettamente formale, dato che consiste nella modifica del titolo. Laltro, invece, è sostanziale e riporta una serie di modifiche correttive ad alcune voci contenute nellallegato 1/B, che riportavano indicazioni erronee tali da rendere scorretta letichettatura delle sostanze pericolose. | | Labeling of hazardous substances and preparations The latest news following the coming into effect of the Ministry of Health Decrees 15/09/2000 and 30/10/2000. Five dates mark the evolution of the regulation of the classification and labeling of hazardous substances and preparations: February 1997, with Legislative Decree n. 52, 3/2/97 Implementation of Directive 92/32/EEC concerning the classification, packaging and labeling of hazardous substances, whereby Italy implements in a single act all the Community rules concerning this matter, creating a kind of single act for these substances, at the same time abrogating the previous rules. April 1997, implementing clause 37, paragraphs 1 and 2, of the above Decree with the issue of Ministerial Decree 28/04/97 by the Ministry of Health, containing the general requirements for the classification and labeling of hazardous substances and preparations in Enclosure VI. In 2000 the Ministry of Health issues Ministerial Decree 10/04/00 that, in Enclosure 4, amends a few parts of Enclosure VI to Ministerial Decree 28/04/97. Again in 2000 Ministerial Decree 15/09/00 is issued with an Enclosure replacing the above Enclosure 4. Finally, on 30 October 2000 Ministerial Decree 30/10/00 is issued that, in addition to amending the title of Ministerial Decree 10/04/00, also replaces a few entries in the relevant Enclosure1/B. But what are the reasons that led the lawmakers to make these amendments, and what has changed as a result? Main changes The Enclosure to the decree issued by the Ministry of Health on 15 September 2000 (hereafter simply Enclosure) replaces Enclosure 4 to Ministerial Decree 10 April 2000 (hereafter simply Enclosure 4). This decree implemented Community Directives 98/73/EC and 98/98/EC bearing the twenty-fourth and twenty-fifth amendments to Council Directive 67/548/EEC concerning the harmonisation of laws, standards and administration rules concerning the classification, packaging and labeling of hazardous substances, disciplined by the Ministerial Decree 28 April 1997 and introduced numerous important changes. Among these are, for example in Enclosure I, the rewording of the text of the introduction to the Decree, and the suppression of a few headings with the introduction of new ones in the list of hazardous substances. But the most important change for the world of packaging - and one that merits a closer look concerns the changes to Enclosure VI (again belonging to Ministerial Decree 28/04/97, hereafter simply Enclosure VI) which sets out the general requisites for the classification and labeling of hazardous substances and preparations. For the sake of clarity, we should point out that the term substances means chemical elements and their compounds, in the natural state or obtained through any production process, including the additives needed to maintain the stability of the products and the impurities deriving from the process in question, excluding solvents, which can be eliminated without affecting the stability of the substances and without changing their composition. The term preparations on the other hand refers to mixtures or solutions consisting of one or more substances (definitions extrapolated from clause 2 of Legislative Decree n. 52, 3 February 1997). Ministerial Decree 10/04/2000 amended this Enclosure VI as follows: - 3.2.3. harmful; - 3.2.8. other toxic properties; - 6.2. phrasing of precautions for substances and preparations; - 8 special cases: substances. These are, however, changes that are no longer relevant in the light of the new, repeated tests conducted to allow the Commission to classify hazardous substances. The test results have thus led to the Commission issuing a decision - 2000/368/EC 19 May 2000 and implemented by Italy with Ministerial Decree 15/09/2000 to correct the existing set of rules to reflect the state of the art with regard to classification, packaging and labeling of hazardous substances (scheme 1). Old and new compared Of the four points mentioned above, the one most worth looking at (and which merits an analysis of the differences found when one compares the new discipline in Enclosure to the old one in Enclosure VI), is most definitely point 6.2. concerning the phrasing of precautions for substances and preparations . It should be said here that the new text has two extra sentences not included in the previous version: - in the event of accidental inhalation, lead the victim outside immediately and make him/her lie down (S 63); - in the event of ingestion, only wash the victims mouth out if he/she is conscious (S 64). Point 6.2 lists the precautions, which describe the most common safety procedures to be adopted to minimize the risks associated with the use of the substances. These are found on the label and product safety sheets using Set phrases, each marked by the letter S followed by a number. There are a few changes in these precautions, some simply in the way things are worded, others in actual substance, concerning both their applicability (section indicating which substances and preparations the precaution applies to) and the criteria of use (section indicating in what context - time, place and usage - the substances and preparations should have precautions on the label). All on the label And its exactly the criteria of use, with the systematic replacement of the phrase ... substances and preparations for retail sale... with ... substances and preparations sold to the public... indicating where and when the phrase containing the precaution must, by law, be indicated on the label of the substance or preparation, that one can see the lawmakers intention to identify this context: not just in terms of retail sale to the end customer, as previously disciplined by Enclosure VI, but also to cover other contexts (for example, wholesale distribution or sale to communities). The sentences affected by this change are marked S1 and S2 (scheme 2). Moreover, again in terms of how the sentences containing precautions must be used on the label of the hazard substance or product, we find that in those marked S13, S18, S20, S29, S33, S46, S50, S51, S56 and S57 there is a preference for the reference ... to current use... of the same (scheme 3) rather than the logic that required that it should appear on labels for all substances and preparations ... for retail sale.... More widespread precautions If we analyse the changes to applicability of the phrasing for precautions for substances and preparations, it should be noted that sentence S45 must be applied to substances and preparations that, in addition to being highly toxic, toxic and corrosive, also lead to irritation if inhaled. Sentences S56, S59 and S60 shall be applied to all hazardous substances and preparations and not just, as set down by Enclosure VI, exclusively for environmentally harmful substances. Finally, other major changes concerning both the use and application are found in the following sentences: - S25, whose application is not just limited to corrosive or irritating substances and preparations, but also to those that are harmful for ones health; - S27, whose use becomes mandatory for all widely used highly toxic substances and preparations (using sentence R 27), while it is recommended for those destined for industrial use and for toxic substances and preparations (using sentence R 24) and, finally, for widely used corrosive substances and preparations); - S28, which recommends the use also for widely used corrosive substances and preparations; - S29, whose application is extended to cover not just extremely or easily flammable liquids that cannot be mixed with water, but also environmentally harmful substances and highly toxic and toxic substances and preparations; - S35, whose application is now extended to cover all hazardous substances and preparations, while its use is recommended for substances and preparations that require special instructions to guarantee their correct disposal; - S37, now also applicable to substances and preparations that provoke irritation on contact with the skin; - S 62, whose use, as well as being recommended for harmful substances and preparations described by sentence R 65 if used in industry, now becomes mandatory when these same products are sold to the public or are widely used (unless sentences S 45 and S 46 are mandatory). Finally, with regard to the latest decree issued by the Ministry of Health (Ministerial Decree 30 October 2000), there are two changes of interest to Ministerial Decree 10/04/00. The first is purely in terms of wording, giving that it consists in a change to the title. The other, however, concerns the substance and introduces a series of corrections to a few entries in Enclosure 1/B, which gave some incorrect details that would have led to incorrect labeling of the hazardous substances. | | | Schema 1 Riportiamo le parti dellAllegato VI al DM 28/04/97 modificate o introdotte dallAllegato 4, sostituito poi dallAllegato ex DM 15/09/00 nei seguenti punti: 3.2.3. Altre proprietà tossicologiche Questo punto, oltre le cinque frasi di rischio R29, R31, R32, R33, R64 presenti in Allegato VI, si completa con laggiunta di altre due frasi: - R 66 Lesposizione ripetuta può provocare secchezza e screpolature della pelle; - R 67 Linalazione dei vapori può provocare sonnolenza e vertigini. 6.2. Frasi relative ai consigli di prudenza per sostanze e preparati In questo punto sono raccolte 54 voci contenenti consigli di sicurezza, di cui dodici sono state modificate e due (le ultime di questo elenco) sono state aggiunte: - S 24 Evitare il contatto con la pelle; - S 25 Evitare il contatto con gli occhi; - S 27 Togliersi di dosso immediatamente gli indumenti contaminati; - S 28 In caso di contatto con la pelle, lavarsi immediatamente e abbondantemente con
(prodotti idonei indicati dal fabbricante); - S 29 Non gettare i residui nelle fognature; - S 35 Non disfarsi del prodotto e del recipiente, se non con le dovute precauzioni; - S 37 Usare guanti adatti; - S 45 In caso di incidente o malessere consultare immediatamente il medico (possibilmente mostrandogli letichetta); - S 56 Smaltire questo materiale e i relativi contenitori in un punto di raccolta rifiuti pericolosi o speciali; - S 59 Richiedere informazioni al produttore o fornitore per il recupero/riciclaggio; - S 60 Questo materiale e il suo contenitore devono essere smaltiti come rifiuti pericolosi; - S 62 In caso di ingestione ,non provocare il vomito; consultare immediatamente un medico e mostrargli il contenitore o letichetta; - S 63 In caso di incidente per inalazione, portare il soggetto allaria aperta e tenerlo a riposo; - S 64 In caso di ingestione, lavare la bocca con acqua (soltanto se la persona è cosciente). 8. Casi particolari: sostanze Composto da quattro voci totali di cui una modificata: - 8.3. Other toxic properties This point, in addition to the five phrases concerning risks R29, R31, R32, R33 and R64 in Enclosure VI, is completed with the addition of two more: - R 66 Repeated exposure may lead to dryness and cracking of the skin; - R 67 Inhalation of the vapours may lead to drowsiness and dizziness. 6.2. Phrasing of precautions for substances and preparations This point contains 54 sentences with safety advice, twelve of which have been altered and two (the last two below) have been added: - S 24 Avoid contact with skin; - S 25 Avoid contact with eyes; - S 27 Take off any contaminated garments immediately; - S 28 If the product comes into contact with the skin, wash the skin immediately and thoroughly with
( suitable products indicated by the manufacturer); - S 29 Do not dispose of down the drain; - S 35 Do not dispose of the product and its container unless all due precautions have been taken; - S 37 Wear suitable gloves; - S 45 In the event of an accident or sickness, consult a doctor immediately (show him/her the label if at all possible); - S 56 Dispose of this material and its containers in a specific depot for hazardous or special waste; - S 59 Apply to the manufacturer or supplier for recovery/recycling instructions; - S 60 This material and its containers must be disposed of as hazardous waste; - S 62 In the event of ingestion, do not provoke vomiting; consult a doctor immediately and show him/her the label; - S 63 In the event of accidental inhalation, lead the victim outside immediately and make him/her lie down (S 63); - in the event of ingestion, wash the victims mouth out (only if he/she is conscious) (S 64). 8.
