| | | | | Legislation: Italian update Coffee and chicory extracts Presidential decree dated 24th July 2000, n° 255 Rules implementing European Directive 1999/4/EC concerning coffee and chicory extracts. After having explained what is meant by coffee extract (art.1) and chicory extract (art. 2), this decree amends the previous law (art. 5, Presidential Decree of 23rd August 1982, n° 774, later amended by Ministerial Decree of 3rd December 1987, n° 599) in article 5, changing the old rules for labeling with regard to legally accepted names. General series n° 213, Tuesday 12th September 2000, page 4) Food products Statute 10th August 2000, n° 259 Implementation of European Directive 1999/10/EC concerning the labeling of food products. Changes to article 8 of statute n° 109 dated 27th January 1992, replaced by article 5 of statute n° 68 of 25th February 2000 concerning the highlighted characterising ingredient. Likewise, also article 6 of statute n° 68 of 25th February 2000 has been amended, since the lawmaker had erroneously omitted to write the part in which it is allowed to indicate the best-by date or the TMC, indicating where on the pack said date is shown. General series n° 220, Wednesday 20th September 2000, page 5) Cosmetics Ministerial Decree (Ministry of Health) dated 17th August 2001 Updating of the lists attached to Law n° n. 713 of 11th October 1986, concerning the production and sale of cosmetics, implementing European Directives 2000/6/EC and 2000/11/EC. Some changes have been made to the wording of the law concerning the composition of cosmetics. These variations can, in turn, have an effect on the labeling of the products. (G.U.R.I. General series n° 248, Monday 23rd October 2000, page 12) Beef Ministerial Decree (Ministry of Agriculture and Forestry) 30th August 2000 Indications and methods for the application of European rules n° 1760/2000 concerning the mandatory and voluntary labeling of beef and beef products. After having defined a few terms, including labeling; beef; prepacked beef etc., (art .1), the decree provides indications on the mandatory labeling of beef (art. 2). Then, in art 3., it provides further terms and the methods of application to be observed by operators wishing to provide extra, voluntary information on their beef. (G.U.R.I. General series n° 268, Thursday 16th November 2000, page 15) Name of Protected Origin and Indication of Protected Areas Ministerial Decree (Ministry of Agriculture and Forestry) of 12th October 2000 Cooperation with consortia responsible for DOP and IGP marks with the Central Fraud Squad in activities of surveillance, protection and defence of the DOP and IGP marks. This decree contains guidelines for a more effective cooperation between the Central Fraud Squad and the consortia responsible for protecting the DOP (Name of Protected Origin) and IGP (Indication of Protected Area) in their activities of surveillance of quality products, with the aim of simplifying the controls required and so make these more effective. General series n° 272, Tuesday 21st November 2000, page 53) Hazardous compounds Ministerial Decree (Ministry of Health) of 19th April 2000 Creation of a database for hazardous compounds, implementing art. 10, paragraph 2 of statute n° 285 dated 16th July 1998. Having deemed it necessary to establish a record of hazardous compounds on the market, to be held by the Ministry of Health, to be used for sanitary purposes in the event of an emergency, this decree establishes (art. 2) that the manufacturers, importers or distributors of hazardous compounds must provide the Ministry with the following information on each compound: A) the name(s) or brand(s) of the compound; B) the name, address, telephone and fax numbers and e-mail address (if any) of the person responsible for introducing the compound on the Italian market; C) the full composition (qualitative and quantitative) of the compound; D) its chemical and physical characteristics; E) its applications; F) the types of packaging used. General series n° 274, Thursday 23rd November 2000, page 36) Legislation: Community updates Ecological mark Rules (EC) 1980/2000 of the European Parliament and the Council, dated 17th July 2000, concerning the revised Community system of assigning a mark of ecological quality. These rules replace the previous rules (EEC) 880/92 governing the European system of ecological product certification (ECOLABEL). Whilst retaining some of the basic characteristics, such as the voluntary nature of the certification and the type of products that may obtain the ECOLABEL, the new system foresees the following important new rules, among others: a) A wider field of application, i.e., not just for products considered as goods, but also as services. b) A wider range of subjects may apply for the ECOLABEL; i.e., not just producers and importers, but also those providing a service, wholesalers and retailers. c) The institution of the EUEB (European Union Eco-labelling Board). A body with the task of preparing a strategy plan, in conjunction with the EU Commission, for the development of the ECOLABEL over the next three years. (GUCE, 21st September 2000, Series L 237, page 1) Ozone Rules (EC) n° 2037/2000 of the European Parliament and the Council dated 29th June 2000 concerning ozone depleting substances. Having found that continuous emissions of ozone depleting substances at current levels cause serious damage to the environment, especially the Southern Hemisphere, the European Union has issued these rules, containing further provisions to protect human health and the environment from the harmful effects of such emissions. In detail, rules n° 2037/2000, repealing rules n° 3093/94 that until now disciplined this matter, not only confirms the ban (already in force in the old rules) on the production of chlorofluorocarbons - apart from a few exceptions for essential uses - and other fully halogenated chlorofluorocarbons, halon, carbon tetrachloride, 1,1,1-trichloroethane and hydrobromofluorocarbons (art. 3). The new rules also ban, except for a few cases, the introduction on the market and the use of the aforementioned controlled substances and any product or appliance containing these (art. 4). The rules also set down controls on the production and use of hydroclorofluorocarbons, as already foreseen for all ozone depleting substances (art 5). (GUCE, 29th September 2000, Series L 244, page 1) Rules (EC) n° 2038/2000 of the European Parliament and the Council dated 28th September 2000, amending rules (EC) n° 2037/2000 concerning ozone depleting substances, with regard to inhalers for the administration of controlled doses and pumps for the administration of medicines. These rules allow, provisionally, for the export to non-European countries of inhalers for the administration of controlled doses and pumps for the administration of medicines containing chlorofluorocarbons. (GUCE, 29th September 2000, Series L 244, page 25) Ecological mark Decision of the Commission dated 10th November 2000, establishing the applicable expenses and fees concerning the system of assigning a European mark of quality. Details on the amounts (fixed between a minimum and a maximum) and possible reductions in the amounts to be paid, both for the examination of the bundle containing the application for the assignation of the ecological quality mark and for the annual fees for the use of the same, in line with the provisions of article 12 of rules (EC) n° 1980/2000. (GUCE, 22nd November 2000, Series L 293, page 18) Decision of the Commission dated 10th November 2000, concerning a standard contract for the conditions of use of the European mark of ecological quality. The enclosures publish a standard contract between those applying for the ecological quality mark and the competent body assigning these, in line with the provisions of article 9 of rules (EC) n° 1980/2000. This decision also allows for the competent body to add extra clauses to the contract, provided that these are compatible with rules (EC) n° 1980/2000. (GUCE, 22nd November 2000, Series L 293, page 20) Decision of the Commission dated 10th November 2000, setting up the European Union Committee for the European mark of ecological quality and establishing its internal rules. The enclosures publish the internal rules of the European Union Committee for the ecological quality mark (CUEME), established by rules n° 1980/2000 (art. 13). These rules govern: its areas of competence and the relevant procedures to be followed in order to fulfil these; its composition; the nomination criteria for the directive organs; calling of meetings. (GUCE 22nd November 2000, Series L 293, page 24) Decision of the Commission dated 10th November 2000, establishing the internal rules of the advisory Forum foreseen by the revised Community system for the assignation of a mark of ecological quality This decision outlines the activities and composition of the members, including establishing the criteria for representation, of the advisory Forum set up by rules n° 1980/2000 (art. 15). (GUCE, 22nd November 2000, Series L 293, page 31) Antidumping Rules (EC) n° 2603/2000 of the Council dated 27th November 2000 introducing a final compensation duty and establishing the final payment of the provisional duty on imports of certain types of polyethylene terephthalates coming from India, Malaysia and Thailand and that ends the anti-dumping measures concerning the importation of certain types of polyethylene terephthalates coming from Indonesia, the Republic of Korea and Taiwan. Ruling (EC) n° 2604/2000 of the Council, dated 27th November 2000 introducing a final antidumping duty and establishing the final payment of the provisional duty on imports of certain types of polyethylene terephthalates coming from India, Indonesia, Malaysia, the Republic of Korea, Taiwan and Thailand. Il testo di legge apporta alcune modifiche in merito alla composizione dei cosmetici. Variazioni queste, che a loro volta possono riflettersi anche sulla relativa etichettatura di tali prodotti. Dopo aver definito alcuni termini tra i quali etichettatura; carni bovine; carne bovina preconfezionata ecc. (art .1), il decreto in oggetto fornisce delle indicazioni sulletichettatura obbligatoria delle carni bovine (art.2). Il Decreto indica le linee guida per realizzare un più efficace coordinamento tra lIspettorato centrale repressione frodi e consorzi di tutela delle DOP (Denominazioni di Origine Protetta) ed IGP (Indicazioni Geografiche Protette) nellesercizio dellattività di vigilanza sulle produzioni di qualità, per addivenire ad una semplificazione dei controlli da svolgersi in materia, al fine di renderli più incisivi. Serie generale n. 272, martedì 21 novembre 2000, pag.53) Preparati pericolosi Decreto Ministero della sanità 19 aprile 2000 Creazione di una banca dati sui preparati pericolosi, in attuazione dellart.10, comma 2, del decreto legislativo n. 285 del 16 luglio 1998. Ritenuto necessario istituire presso lIstituto superiore di sanità un archivio dei preparati pericolosi presenti sul mercato, da usare per scopi sanitari in casi demergenza, il decreto in questione stabilisce (art 2) che i fabbricanti, gli importatori o i distributori di preparati pericolosi devono fornire allIstituto superiore della sanità, per ciascun preparato, le seguenti informazioni: A) la o le denominazioni o nomi commerciali del preparato; B) il nome, lindirizzo, lindicazione del numero di telefono, del telefax, ed eventuali indirizzi di posta elettronica del responsabile dellimmissione sul mercato italiano; C) la composizione qualitativa e quantitativa completa del preparato; D) le caratteristiche chimico fisiche; E) le tipologie dimpiego; F) i tipi dimballaggio. Serie generale n. 274, giovedì 23 novembre 2000, pag.36) Legislazione: aggiornamento comunitario Marchio ecologico Regolamento (CE) 1980/2000 del Parlamento europeo e del Consiglio, del 17 luglio 2000, relativo al sistema comunitario, riesaminato, di assegnazione di un marchio di qualità ecologica. Il regolamento in questione sostituisce il regolamento (CEE) 880/92 disciplinante il sistema europeo di certificazione ecologica dei prodotti (ECOLABEL). Pur conservando alcune caratteristiche di fondo quali laccesso volontario ed il genere di prodotti a cui può essere concessa la ecoetichetta, la nuova disciplina prevede tra le novità più rilevanti: a) Un campo di applicazione più ampio e cioè per prodotti non solo intesi come beni, ma anche come servizi. b) Una rosa più ampia di soggetti che possono richiedere ECOLABEL; ovvero non solo i produttori e gli importatori, ma anche i prestatori di servizi, i venditori allingrosso e al dettaglio. c) Istituzione dellEUEB (European Union Eco-labelling Board). Un organismo che ha il compito di elaborare assieme alla Commissione Ue il piano strategico per sviluppare ECOLABEL per i prossimi tre anni. (GUCE 21 settembre 2000, Serie L 237, pag. 1) Ozono Regolamento (CE) n. 2037/2000 del Parlamento europeo e del Consiglio del 29 giugno 2000, sulle sostanze che riducono lozono. Accertato che le continue emissioni di sostanze riducenti lo strato di ozono ai livelli attuali causano un grave danno allambiente, soprattutto nellemisfero meridionale, lUnione Europea ha emanato il regolamento in questione, che contiene provvedimenti per proteggere ulteriormente la salute umana e lambiente dagli effetti nocivi derivanti da tali emissioni. Nello specifico il regolamento n. 2037/2000, abrogando il regolamento n. 3093/94, disciplinate fino ad oggi la materia, non solo conferma il divieto (già vigente nella vecchia normativa), fatte salve alcune deroghe per usi essenziali, della produzione di clorofluorocarburi; altri clorofluorocarburi completamente alogenati; halon; tetracloruro di carbonio; 1,1,1-tricloroetano; idrobromofluorocarburi (art. 3). Ma vieta anche, ad eccezione di alcuni casi, limmissione sul mercato e luso sia delle sopracitate sostanze controllate, sia di prodotti e apparecchiature che le contengono (art. 4). Il regolamento inoltre stabilisce anche per gli idroclorofluorocarburi il controllo sulla produzione e luso, così come previsto per tutte le sostanze che riducono lo strato di ozono (art 5). (GUCE 29 settembre 2000, Serie L 244, pag. 1) Regolamento (CE) n. 2038/2000 del Parlamento europeo e del consiglio del 28 settembre 2000, che modifica il regolamento (CE) n. 2037/2000 sulle sostanze che riducono lo strato di ozono relativamente agli inalatori per la somministrazione di dosi controllate e alle pompe per la somministrazione di farmaci. In pratica il regolamento consente, temporaneamente, lesportazione verso paesi terzi degli inalatori per la somministrazione di dosi controllate e delle pompe per la somministrazione di farmaci contenenti clorofluorocarburi. (GUCE 29 settembre 2000, Serie L 244, pag. 25) Marchio ecologico Decisione della Commissione del 10 novembre 2000, che fissa le spese e i diritti da applicare nellambito del sistema di assegnazione di un marchio comunitario di qualità. Precisazioni sugli importi (fissati tra un minimo ed un massimo) e su eventuali riduzioni relative alle somme da pagare, sia per lesame del fascicolo contenente la richiesta di assegnazione del marchio di qualità ecologica, sia per i diritti annuali per lutilizzazione dello stesso, secondo quanto stabilisce larticolo 12 del regolamento (CE) 1980/2000. (GUCE 22 novembre 2000, Serie L 293, pag. 18) Decisione della Commissione del 10 novembre 2000, concernente un contratto tipo relativo alle condizioni di uso del marchio comunitario di qualità ecologica. In allegato viene pubblicato un contratto tipo tra i richiedenti un marchio di qualità ecologica e lorganismo competente che lo concede, ai sensi dellarticolo 9 del regolamento (CE) n. 1980/2000. La decisione consente inoltre allorganismo competente, di aggiungere al contratto altre clausole, purché compatibili con il regolamento (CE) n. 1980/2000. Ricorso dannullamento - regolamento (CE) n. 2815/98 - La Corte di giustizia del Lussemburgo respinge il ricorso presentato dallItalia, mirante ad ottenere, in via principale, lannullamento del Regolamento (CE) della Commissione 22 dicembre 1998 n. 2815, nella parte in cui si afferma il principio secondo cui lorigine dellolio è definita in etichetta dal luogo in cui è avvenuta lultima trasformazione (cioè la molitura) e non, come invece sostiene il ricorrente, dal luogo da cui provengono e vengono lavorate le olive. Appeal for repeal - rules (EC) n° 2815/98 - The Court of Justice in Luxembourg has rejected the appeal made by Italy with the goal, as a preliminary step, of repealing Commission Rules (EC) of 22nd December 1998 n° 2815, in that part stating the principle according to which the origin of the oil is defined on the label as the place where the last process of transformation (i.e., pressing) took place and not, as the appealing party claims, where the olives were picked and processed. The Rules in question govern the marketing of olive oil and allow for oil produced using imported oils, but pressed in Italy, to be labeled as produce of Italy.
