| | | | | Legislation: Italian update Hazardous substances Decree of the Ministry of Health, 30th October 2000 Amendment to Ministerial Decree 10th April 2000 implementing European Commission Directive 98/98/EC dated 15th December 1998 and amendments to European Commission Directives 98/73/EC and 98/98/EC, bearing the 24th and 25th amendments to reflect the state of the art to Council Directive 67/548/EEC concerning harmonisation of legislation, rules and administrative regulations regarding the classification, packaging and labeling of hazardous substances. The decree in question replaces the title and a few entries in Enclosure 1/B of the decree of 10 April 2000. (G.U.R.I. Ordinary supplement n. 23 to G.U.R.I. n. 33 of 9th February 2001) Faulty products Legislative decree 2nd February 2001, n. 25 Implementation of European Directive 1999/34/EC modifying Directive 85/374/EEC regarding liability for damage arising from faulty products. Contrary to the provisions in Presidential Decree 224/1888, the decree in question considers the term Product to cover also agricultural products (crops, livestock, fishing and hunting). As a result, farmers, breeders, fishermen and hunters are listed as producers. (G.U.R.I. General Series n. 49, dated 28th February 2001, page 6) Footwear Decree of the Ministry of Industry, Trade and Crafts, 30th January 2001 Amendment to the decree dated 11th April 1996, bearing the Implementation of Directive 94/11/EC of the European Parliament and Council dated 23rd March 1994 concerning harmonisation of legislation, rules and administrative regulations in Member States regarding the labeling of materials used in the main components of shoes destined for sale to the consumer. Specification of the Italian origin of the shoes may be made by adding the wording sole made in Italy on the inside of the sole exclusively. The wording must be in Italian or another official language of the European Community. (G.U.R.I. General Series n. 37, dated 14th February 2001, page 46) Steel and iron industry Decree of the President of the Republic 15th December 2000, n. 439 Simplification regulations concerning the abrogation of the standards governing the procedure for the reorganisation of the steel and iron industry (n. 57, Enclosure 1, Law n. 59/1997). This decree suppresses the provisions for the concession of contributions for the reorganisation of the steel and iron industry provided for under Law n. 193 of 31st May 1984. (G.U.R.I. General Series n. 32, dated 8th February 2001, page 3) Plant health products Decree of the Ministry of Health 3rd January 2001 Update to the decree of the Ministry of Health dated 19th May 2000 and implementation of European Directives n. 2000/42/EC and 2000/48/EC concerning the maximum acceptable levels of residues of active substances in plant health products in cereals, animal products and vegetable products, including fresh produce; revokes and amends a few uses of plant health products. List of obligations to be observed by those with authorisation to use plant health products, whose labels indicate the combinations of active substance/crop listed in Enclosures 4 and 5 of this decree. (G.U.R.I Ordinary supplement n. 24 to G.U.R.I. n. 34 dated 10th February 2001) Legislation: Community updates Transport of hazardous goods Commission Directive 2001/6/EC of 29th January 2001, adapting for the third time Council Directive 96/49/EC to reflect the state of the art in order to harmonise the legislation of the various Member States concerning the transport of hazardous goods by rail. and Commission Directive 2001/7/EC of 29th January 2001, adapting for the third time Council Directive 94/55/EC to reflect the state of the art in order to harmonise the legislation of the various Member States concerning the transport of hazardous goods by road These directives replace the Enclosure to Directive 96/49/EC and Enclosures A and B of Directive 94/55/CE respectively. Even so, the final versions of these enclosures are still not available on the Official Gazette series L 30. The translation into all Community languages will only be made available when the final wording of the 2001 version of the RID is ready and the final wording of the 2001 version of Enclosures A and B of the ADR has been settled. Directives 6 and 7 of 2001 will come into effect on the twentieth day after publication. Moreover, harmonisation of the list of waste in line with Community provisions: Directive 75/442/EEC (waste) and 91/689/EEC (hazardous waste). (G.U.C.E. series L 47, dated 16th February 2001, page 1) Decision of the Commission n. 2001/119/EC dated 22nd January 2001 amending Decision 2000/532/EC, replacing Decision 94/3/EC establishing a list of waste complying with clause 1, letter a) of Council Directive 75/442/EEC on waste and Decision of the Council 94/904/EC establishing a list of hazardous waste under clause 1, paragraph 4, of Directive 91/689/EEC concerning hazardous waste Entry 16 01 04 vehicles unsuitable for use is replaced by entry 16 01 04 vehicles out of service in the list mentioned above. (G.U.C.E. series L 47, dated 16th February 2001, page 32) Food products Decision of the Commission 2001/122/EC dated 30th January 2001 Authorising the introduction on the market of a preparation of destrano, produced from Leuconostoc Mesenteroides, as a new food ingredient in bakery products within the scope of European Parliament and Council regulations n. 258/97/EC. Use of the destrano preparation, produced from the Leuconostoc mesenteroides bacteria, is permitted as a new food ingredient in bakery products on the condition that the final bakery product does not contain more than 5% in weight of the destrano preparation. (G.U.C.E. series L 44, dated 15th February 2001, page 46) European Parliament and Council Directive 2001/5/EC dated 12th February 2001, amending Directive 95/2/EC concerning food additives other than colourings and sweeteners The changes introduced by this directive in the list - introduced by Directive 95/2/EC of food additives that may be used within the European Community and their conditions of use affect the labeling of food products. Contrariamente a quanto disponeva il DPR 224/1888, il decreto in esame considera Prodotto anche i prodotti agricoli del suolo, dellallevamento, della pesca e della caccia. Di conseguenza sono annoverati fra i produttori lagricoltore, lallevatore, il pescatore ed il cacciatore. (G.U.R.I. Serie Generale n° 49, del 28 febbraio 2001, pag. 6) Calzature Decreto Ministero dellindustria del Commercio e dellArtigianato 30 gennaio 2001 Modifica al decreto dell11 aprile 1996, recante il Recepimento della direttiva 94/11/CE del Parlamento europeo e del Consiglio del 23 marzo 1994 sul riavvicinamento delle disposizioni legislative, regolamentari e amministrative degli Stati membri riguardo letichettatura dei materiali usati nelle principali componenti delle calzature destinate alla vendita al consumatore. La specificazione dellorigine italiana della calzatura può essere fatta apponendo la dicitura suola prodotta in Italia esclusivamente nella parte interna della suola stessa. La dicitura deve essere apposta in italiano o in altra lingua ufficiale della Comunità. (G.U.R.I. Serie Generale n° 37, del 14 febbraio 2001, pag. 46) Industria siderurgica Decreto del Presidente della Repubblica 15 dicembre 2000, n° 439 Regolamento di semplificazione concernente labrogazione della normativa sul procedimento per il risanamento dellindustria siderurgica (n° 57, allegato 1, della legge n° 59/1997). Con questo decreto vengono soppressi i provvedimenti per la concessione di contributi per il risanamento della siderurgia, previsti dalla legge 31 maggio 1984 n°193. (G.U.R.I.
