I.N.R.A.N. statute
Ministerial decree on agricultural and forestry policy 21 May 2004
Approval of the statute of the National Institute for Research into Foodstuffs and Nutrition (I.N.R.A.N.), Rome.
Among the activities foreseen by the I.N.R.A.N. statute listed in the decree are the following:
• to carry out research, information and promotional activities in the area of foodstuffs and nutrition, aimed at protection of the consumer protection and the qualitative improvement of agrofood production.
• to promote and develop research activities into quality, aimed at certification and nutritional labeling, and to raise awareness of the specificity of national products, as well as the development of biotechnological applications in the food sector.
I.N.R.A.N will carry out the above activities in collaboration with the Higher Institute of Health, with the exception of health hygiene aspects which are the responsibility of the Ministry of Health and the National Health Service.

Labeling of fresh milk and tomato pulp Decree Law 24 June 2004, No. 157
Urgent measures for the labeling of certain agrofood products, as well as those concerning agricultural and fish products.
Two provisions should be mentioned:
1) The wording ‘pasteurised fresh milk’ and ‘high quality pasteurised fresh milk’, to be shown on the labeling of cow’s milk intended for human consumption is exclusively limited to milk produced in conformity with art. 4, clauses 1 and 2 of Law 169/89; even if it is not directly stated, it is forbidden to use the wording ‘fresh’ for micro-filtered milk.
2) The wording ‘tomato pulp’, to be shown on the labeling of product produced from the processing of tomatoes, is limited to product obtained from the pressing of fresh tomatoes.
The decree-law came into effect on 26 June.

Fruit juices
Legislative decree 21 May 2004, No. 151
Implementation of directive 2001/112/CE, concerning fruit juices and other similar products intended for human consumption.
New regulations apply to fruit juices, including:
- the area of application of the decree (art.1)
- possible additives to the products (art. 2),
- the treatments to which the products are subjected (art. 3),
- the sales wording (art. 4).

Olive oil
• Decree of the Ministry of Agricultural and Forestry Policies 29 April 2004
Regulations applying to the rules for the marketing of olive oil covered in regulation (CE) No. 1019/02 of the Commission of 13 June 2002.
The decree provides for the identification of the body charged with checking the application of regulation (CE) No. 1019/02 on the rules for the marketing of olive oil.

• Decree of the Ministry of Agricultural and Forestry Policies 4 June 2004
Implementation of ministerial decree of 29 April 2004, which states: ‘Regulations applying to the checking of the rules for the marketing of olive oil, as in regulation (CE) No. 1019/2002 of the Commission of 13 June 2002’.
This decree establishes the operative methods stated in the ministerial decree of 29 April 2004.

Plant protection products
Decree 9 April 2004
Implementation of directives Nos. 2003/113/CE, 2003/118/CE and 2004/2/CE and updating of decree of the Ministry of Health of 19 May 2000, regarding the maximum limits for the residues of active substances contained in plant protection products tolerated in products intended for human consumption.
This decree establishes the maximum limits for the residues of active substances contained in plant protection products tolerated in products stated in attachment 1, parts A, B, C, D and E (fresh fruit, vegetables, mushrooms, cereals, etc.) in the decree of the Ministry of Health 19 May 2000.

Honey: production and marketing
Legislative decree 21 May 2004, No.179
Implementation of directive 2001/110/CE regarding the production and marketing of honey.
Honey can be classified:
a) according to its origin (flower or nectar honey, blossom honey),
b) according to the production or extraction method (in honeycomb, with pieces of honeycomb, by draining, centrifuge, pressing or filtering).
The sales wording ‘honey’ is limited to honey defined as ‘a sweet natural substance produced by bees (Apis mellifera) from the nectar of plants or from secretions from the living parts of plants or from substances secreted by sucking insects found in the living parts of plants which they absorb, process, and combine with their own specific substances, deposit, dry, store and leave to mature in the honeycombs of the beehives’.
The decree also defines the characteristics of industrial honey, with the methods of use and labeling (intended only for the preparation of cooked foodstuffs).
The country or countries of origin in which the honey is collected must be indicated on the labeling.
Honey intended for purchase by consumers must be pre-packet at the place of origin in closed containers according to the methods indicated in D.Lgs. 109/92.
The decree came into effect on 21/07/04.

Nutritional supplements
Legislative decree 21 May 2004, No.169
Implementation of directive 2002/46/CE relating to nutritional supplements.
The decree applies to nutritional supplements marketed in pre-packed form as food products and presented as such. Important for consumer protection are the regulations contained in the Article regarding labeling, publicity and distribution to the market.

Detergents
EC Rules n° 648/2004 of the European Parliament and Council, dated 31st March 2004, concerning detergents.
Rules standardising the rules concerning the sale of detergent components.

Food labeling
Directive 2004/77/EC of the European Commission dated 29 April 2004 amending Directive 94/54/EC regarding the labeling of certain food products containing glycyrrhizinic acid and its ammonium salts.
This directive provides for mandatory labeling of those products containing liquorice. The label must provide consumers with clear indications about the presence of glycyrrhizinic acid or its ammonium salts in confectionary products and beverages. In the event of a high content of such substances in the products in question, consumers - especially those suffering from high blood pressure - should be dissuaded from excessive consumption of the same. To make this information easier for consumers to understand, the generally accepted wording "liquorice extracts" should be used.

Materials and objects made from plastic destined to come into contact with food
Directive 2004/19/EC of the European Commission dated 1st March 2004 amending Directive 2002/72/EC concerning materials and objects made from plastic and destined to come into contact with food.
Update of Directive 2002/72/EC with amendments, replacements and updates in enclosures: I, III, IV, V, and VI.
This directive contains a list of the monomers and other raw materials that can be used to produce plastic materials and objects. On the basis of fresh data, certain monomers temporarily authorised on a national level and new monomers should now be added to the Community list of allowed substances contained in this directive.
Directive 2002/72/EC also contains an incomplete list of the additives that can be used to produce plastic materials and objects. This list should now be altered to include other additives that have been found by the European authority to be suitable for food safety.

Food additives
Directive 2004/45/EC of the European Commission dated 16th April 2004 amending Directive 96/77/EC which establishes the specific requirements of purity for food additives other than colourings and sweeteners.
In its opinion dated 5th March 2003, the Scientific Committee for Human Food has reached the conclusion that it is best to limit the presence of low molecule weight carragenin to an absolute minimum. As a result, the purity criteria currently applied to carragenin (E 407) and converted alga Eucheuma (E 407a) set in Directive 96/77/EC need to be altered accordingly.

Presentation and external indications for market garden produce
EC Rules n° 907/2004 of the Commission dated 29th April 2004, amending the applicable standards for the sale of fresh garden produce with regard to their presentation and external indications.
The standards for the sale of fresh market garden produce establish rules about the presentation of the products in the packaging and require that each pack must bear all the information needed to identify the packer or shipper, the nature of the product, its origin and relevant commercial characteristics.
According to common practice in the trade, self-adhesive labels are applied to the individual fruit for advertising or other purposes. The use of such stickers for more fragile products has led to the need to prevent the products from being damaged by the labels.
The provisions of the rules in question include the following:
- The labels placed on the individual products must be easily removed without leaving behind any visible traces of glue or defects in the skin or peel.
- There is no need to include the indications (type and origin of product, commercial details) on packs when these contain sale packs containing such information and clearly visible from the outside. The packs must not bear any external indications that could lead to misunderstandings. If the packs have been palletised, the indications must appear on a list attached in a clearly visible position on at least two sides of the pallet.

Legislazione: aggiornamento nazionale

Statuto I.N.R.A.N.
Decreto ministero delle politiche agricole e forestali 21 maggio 2004
Approvazione dello statuto dell'Istituto nazionale di ricerca per gli alimenti e la nutrizione - I.N.R.A.N. di Roma.
Tra le attività previste dallo statuto dell’I.N.R.A.N., elencate dal presente decreto figurano quelle di:
• svolgere attività di ricerca, informazione e promozione nel campo degli alimenti e della nutrizione, finallizzate alla tutela del consumatore e al miglioramento qualitativo delle produzioni agroalimentari.
• promuovere e sviluppare attività di ricerca sulla qualità, finalizzate alla certificazione, etichettatura nutrizionale e valorizzazione delle specificità dei prodotti nazionali, nonché allo sviluppo delle applicazioni biotecnologiche nel settore alimentare.
L’ I.N.R.A.N svolge le attività di cui sopra in collaborazione con l'Istituto Superiore di Sanità, con l'esclusione degli aspetti igienico sanitari di competenza del Ministero della salute e del Servizio sanitario nazionale.

Etichettatura di latte fresco e passata di pomodoro
Decreto Legge 24 Giugno 2004, n. 157
Disposizioni urgenti per l'etichettatura di alcuni prodotti agroalimentari, nonché in materia di agricoltura e pesca.
Sono due le disposizioni da segnalare:
1) Le denominazioni "latte fresco pastorizzato" e "latte fresco pastorizzato di alta qualità", da riportare nella etichettatura del latte vaccino destinato al consumo umano, sono esclusivamente riservate al latte prodotto conformemente all'art. 4, commi 1 e 2, della Legge 169/89; anche se non citato direttamente viene quindi vietata l'indicazione "fresco" per il latte microfiltrato.
2) La denominazione di vendita "passata di pomodoro", da riportare nell’etichettatura del prodotto derivante dalla trasformazione del pomodoro, è riservata al prodotto ottenuto dalla spremitura diretta del pomodoro fresco.
Il decreto-legge è entrato in vigore il 26 giugno.

Succhi di frutta
Decreto Legislativo 21 Maggio 2004, n. 151
Attuazione della direttiva 2001/112/CE, concernente i succhi di frutta ed altri prodotti analoghi destinati all'alimentazione umana.
Nuove disposizioni regolamentano i succhi di frutta a partire da: - campo d’applicazione del decreto (art.1)
- la possibilità di aggiunte ai prodotti (art. 2),
- i trattamenti a cui sono sottoposti i prodotti (art. 3),
- le denominazioni di vendita (art. 4).

Il decreto provvede all’individuazione degli organismi incaricati dei controlli sull'applicazione del regolamento (CE) n. 1019/02 sulle norme di commercializzazione dell’olio d’oliva.

Il Presente decreto stabilisce le modalità operative previste dal decreto ministeriale 29 aprile 2004.

Prodotti fitosanitari
Decreto 9 aprile 2004
Recepimento delle direttive n. 2003/113/CE, 2003/118/CE e 2004/2/CE e aggiornamento del decreto del Ministro della sanità 19 maggio 2000, concernente i limiti massimi di residui di sostanze attive contenute nei prodotti fitosanitari tollerati nei prodotti destinati all'alimentazione.
Il presente decreto stabilisce i limiti massimi di residui di sostanze attive contenute nei prodotti fitosanitari tollerate nei prodotti di cui all'allegato 1, parti A, B, C, D, E (frutta fresca, ortaggi, funghi, cereali,ecc) del decreto del Ministro della sanità 19 maggio 2000.

Miele, produzione e commercio
Decreto Legislativo 21 maggio 2004, n.179
Attuazione della direttiva 2001/110/CE concernente la produzione e la commercializzazione del miele.
Il decreto definisce le caratteristiche che deve avere il miele per poter essere commercializzato.
Il miele può essere classificato:
a) secondo l'origine (miele di fiori o miele di nettare, miele di melata),
b) secondo il metodo di produzione o di estrazione (in favo, con pezzi di favo, scolato, centrifugato, torchiato, filtrato).
La denominazione di vendita "miele" è riservata al miele definito come “sostanza dolce naturale che le api (Apis mellifera) producono dal nettare di piante o dalle secrezioni provenienti da parti vive di piante o dalle sostanze secrete da insetti succhiatori che si trovano su parti vive di piante che esse bottinano, trasformano, combinandole con sostanze specifiche proprie, depositano, disidratano, immagazzinano e lasciano maturare nei favi dell'alveare”
Sono anche definite le caratteristiche del miele industriale, con le modalità di utilizzo ed etichettatura (destinato solo alla preparazione di cibi cotti).
Sull'etichetta devono essere indicati il Paese o i Paesi d'origine in cui il miele è stato raccolto.
Il miele destinato ai consumatori deve essere preconfezionato all'origine in contenitori chiusi secondo le modalità indicate dal D.Lgs. 109/92.
Il testo è entrato in vigore il 21/07/04.

Integratori alimentari
Decreto Legislativo 21 maggio 2004, n.169
Attuazione della direttiva 2002/46/CE relativa agli integratori alimentari.
Il decreto si applica agli integratori alimentari commercializzati in forma preconfezionata come prodotti alimentari e presentati come tali. Importanti, a tutela del consumatore, sono le disposizioni contenute negli articoli che riguardano la loro etichettatura, pubblicità e immissione in commercio.

Detergenti
Regolamento (CE) n. 648/2004 del Parlamento europeo e del Consiglio, del 31 marzo 2004, relativo ai detergenti.
Il regolamento armonizza le norme relative all'immissione sul mercato dei componenti dei detergenti.

Etichettatura food
Direttiva 2004/77/CE della Commissione del 29 aprile 2004 che modifica la direttiva 94/54/CE per quanto riguarda l'etichettatura di taluni prodotti alimentari contenenti acido glicirrizico e il suo sale di ammonio.
La direttiva dispone l’etichettatura obbligatoria per i prodotti che contengono liquirizia. In tale ottica, si rivela necessaria un'etichettatura che fornisca ai consumatori chiare indicazioni riguardo alla presenza di acido glicirrizico o del suo sale di ammonio nei prodotti dolciari e nelle bevande. In caso di elevato tenore di tali sostanze nei prodotti in questione, i consumatori, e in particolare quelli affetti da ipertensione, devono essere dissuasi da un consumo eccessivo. Per facilitare la comprensione di tali informazioni da parte dei consumatori, è preferibile utilizzare la dicitura generalmente diffusa di "estratti di liquirizia"

Materiali e oggetti di materia plastica a contatto con alimenti
Direttiva 2004/19/CE della Commissione del 1° marzo 2004 che modifica la direttiva 2002/72/CE relativa ai materiali e agli oggetti di materia plastica destinati a venire a contatto con i prodotti alimentari.
Aggiornamenti alla direttiva 2002 / 72/CE con modifiche, sostituzioni ed aggiornamenti agli allegati: I, III, IV, V, e VI.
Essa contiene un elenco dei monomeri e delle altre sostanze di partenza che possono essere utilizzati per la fabbricazione di materiali ed oggetti di materia plastica. Sulla base di nuovi dati, alcuni monomeri temporaneamente autorizzati a livello nazionale e nuovi monomeri devono essere inclusi nell'elenco comunitario delle sostanze consentite contenuto nella suddetta direttiva.
La direttiva 2002/72/CE contiene inoltre un elenco incompleto degli additivi che possono essere utilizzati per la fabbricazione di materiali ed oggetti di materia plastica. Tale elenco deve essere modificato in modo da comprendere altri additivi che sono stati valutati dall'Autorità europea per la sicurezza alimentare.

Additivi alimentari
Direttiva 2004/45/CE della Commissione del 16 aprile 2004 recante modifica della direttiva 96/77/CE che stabilisce i requisiti di purezza specifici per gli additivi alimentari diversi dai coloranti e dagli edulcoranti.
Nel suo parere del 5 marzo 2003, il comitato scientifico dell'alimentazione umana è giunto alla conclusione che fosse opportuno limitare al minimo possibile la presenza di carragenina a basso peso molecolare.
Di conseguenza, è necessario adeguare i criteri di purezza corrispondenti attualmente applicabili alla carragenina (E 407) e all'alga eucheuma trasformata (E 407a), così come stabiliti nella direttiva 96/77/CE.

Presentazione e indicazioni esterne per gli ortofrutticoli
Regolamento (CE) n. 907/2004 della Commissione, del 29 aprile 2004, che modifica le norme di commercializzazione applicabili agli ortofrutticoli freschi per quanto riguarda la presentazione e le indicazioni esterne.
Le norme di commercializzazione degli ortofrutticoli freschi stabiliscono disposizioni sulla presentazione dei prodotti nell'imballaggio ed esigono che su ogni imballaggio debbano figurare tutte le informazioni richieste per l'identificazione dell'imballatore o dello speditore, la natura del prodotto, la sua origine e le relative caratteristiche commerciali.
Secondo la pratica comune del settore sono fissate etichette autoadesive sui singoli frutti a scopi di pubblicità o di altro tipo.
L'applicazione di questa pratica nel caso dei prodotti più fragili rende necessario adottare regole per evitare che i prodotti siano danneggiati da tali etichette. Tra le prescrizioni del regolamento in questione si segnala:
- Le etichette apposte individualmente sui prodotti devono poter essere tolte senza lasciare tracce visibili di colla e difetti della buccia.
- Non è necessario apporre le indicazioni (tipo natura e origine del prodotto, caratteristiche commerciali) sui colli quando questi ultimi contengono imballaggi di vendita visibili dall'esterno che recano dette indicazioni.
I colli non devono recare alcuna indicazione esterna che possa indurre in errore. Qualora i colli siano palettizzati, dette indicazioni devono figurare su una scheda apposta in maniera visibile almeno su due lati del pallet.
