Food additives
Ministerial Decree of the Ministry of Health, July 23rd, 2003
Implementation of Directive 2002/82/EC of the European Commission dated October 15th, 2002, bearing changes to European Directive 96/77/EC establishing the specific requirements for purity in food additives other than colorants and sweeteners.
This decree abrogates the provisions of the Ministerial Decree of the Ministry of Health n° 356, dated August 4th, 1997, recently amended by Decree dated May 6th, 2002, and published in the ordinary supplement to the Official Journal n° 147 dated June 25th, 2002, concerning specific requirements for purity in the food additives listed in Enclosure I of these rules.
The food additives listed in Enclosure I must satisfy the specific purity requirements set out in Enclosure II of these rules.
The elements needed to identify the various substances are indicated (such as synonyms, chemical names, EINECS number, chemical formula and other characteristics).

Pesticides
Ministerial Decree of the Ministry of Health, July 23rd, 2003
Implementation of European Directive 2002/63/EC dated July 11th 2002 concerning sampling methods for official control of residues of pesticides in food of plant and animal origin.
This decree describes in an enclosure the sampling methods for food products in order to control pesticide residues (active substances in plant health products), in accordance with art. 6 of ministerial Decree 19/05/00.
Presidential Decree n° 327/80 applies for all matters not specifically dealt with in the new rules, as this governs hygiene during production and sale of food substances and drinks.
The Decree of the Ministry of health dated December 20th 1980 entitled “Sampling methods for controlling residues of pesticides in and on fruit and vegetables” is thus abrogated with the coming into effect of this decree.

Recycled material
Decree of the Ministry of the Environment and Care of the Land, May 8th 2003, n° 203.
Rules to ensure that public offices and companies with a majority public shareholding cover the annual requirements for goods and products with a quota of products obtained from recycled material of not less than 30% of said requirements.
Decree issued by the Minister of the Environment and Care of the Land together with the Minister of Manufacturing and the Minister of Health.

Mineral water
Decree of the Ministry of Health, September 11th 2003
Implementation of Directive n° 2003/40/EC of the European Commission with regard to the part concerning the labeling of mineral water and spring water.
Art. 1 specifies the information to be found on the label concerning fluorine contents of natural mineral water in order to safegaurd the health of babies and infants under the age of 7 in particular.
Art. 2 concerns the mandatory labeling regarding the treatment with ozone-enriched air of natural mineral water and spring water.
The sale of natural mineral water and spring water with labels that fail to comply with the provisions of the decree is banned from July 1st 2004 (unless said date is extended due to stocks running out beforehand).

Cosmetic products
2003/80/EC: Directive of the Commission dated September 5th 2003 establishing in Enclosure VIII b of Directive 76/768/EEC of the Council the symbol that indicates the length of time that cosmetic products are suitable for use.
In the case of cosmetic products whose minimum duration is more than thirty months, there should also be an indication concerning the period of time that the product can still be used, once opened, without any harmful effects for the consumer.
To this end, art. 6, paragraph 1, letter c) of Directive 76/768/EEC of the Council requires the use of a symbol followed by an indication of the "use by" period (expressed in months and/or years).
This Directive, with the symbol and wording, completes the requirements of Directive n° 76/768.

Collagen
2003/721/EC: Decision of the Commission dated September 29th 2003 bearing changes to Directive 92/118/EEC of the Council with regard to the conditions for collagen for human use and abrogation of Decision 2003/42/EC.
As with gelatine, also collagen for human use is governed by the same discipline with regard to the sanitary conditions for its packing, packaging, storage and shipment.
These stages must be carried out under satisfactory hygienic conditions and there must, especially, be a special area for storage, packing and packaging. The packing and packaging must be done in rooms and on surfaces suitable for this specific purpose.
Packs and packages containing collagen must bear an identifying mark indicating the name or code of the country of origin, followed by the factory registration number. It must also bear the wording “Collagen for human use”.

Additives for animal feed
Rules (EC) n° 1831/2003 of the European Parliament and Council, dated September 22nd, concerning additives destined for animal feed.
The purpose of these rules is to set up a Community procedure for the authorisation of the sale and use of additives for animal feed, as well as to introduce standards for the control and labeling of such additives and mixtures of additives for animal feed.
As a result, no one may sell an additive for animal feed or a mixture of such additives if the packaging or container has not been labeled under the responsibility of a producer, packaging manager, importer, seller or distributor seated within the Community and does not clearly and indelibly indicate in at least the language or languages of the Member State in which it is sold, a series of information, including: the specific name given to the additives in the authorisation; the net weight or, in the case of liquid additives and liquid mixtures, the net volume or net weight; user instructions and recommendations concerning safe use, etc.

Additivi alimentari
Decreto del Ministero della salute 23 luglio 2003
Recepimento della direttiva 2002/82/CE della Commissione del 15 ottobre 2002 recante modifica della direttiva 96/77/CE che stabilisce i requisiti di purezza specifici per gli additivi alimentari diversi dai coloranti e dagli edulcoranti.
Il decreto abroga le disposizioni del decreto del Ministro della sanità del 4 agosto 1997, n. 356, modificato da ultimo con il decreto del 6 maggio 2002, pubblicato nel supplemento ordinario alla Gazzetta Ufficiale n. 147 del 25 giugno 2002, relative ai requisiti specifici di purezza degli additivi alimentari elencati nell'allegato I del presente regolamento.
Gli additivi alimentari elencati nell'allegato I devono possedere i requisiti di purezza specifici riportati nell'allegato II del presente regolamento
Per i vari elementi sono indicati gli elementi utili all'identificazione come i sinonimi, la denominazione chimica, il numero EINECS, la formula chimica e altre caratteristiche.

Antiparassitari
Decreto del Ministero della salute 23 luglio 2003
Attuazione della direttiva 2002/63/CE 11 luglio 2002 relativa ai metodi di campionamento ai fini del controllo ufficiale dei residui di antiparassitari nei prodotti alimentari di origine vegetale e animale.
Il decreto contiene in allegato le modalità di prelevamento dei campioni di prodotti alimentari per il controllo dei residui di antiparassitari (sostanze attive dei prodotti fitosanitari), ai sensi dell'art. 6 del DM 19/05/00.
Per tutto quanto non compreso nella nuova disposizione viene fatto riferimento al DPR 327/80 che regola la disciplina igienica della produzione e della vendita delle sostanze alimentari e delle bevande. Con l'entrata in vigore di questo decreto è abrogato il decreto del Ministro della Sanità 20 dicembre 1980 dal titolo "Modalità di prelevamento dei campioni per il controllo dei residui di antiparassitari negli e sugli ortofrutticoli".

Materiale riciclato
Decreto del Ministero dell’ambiente e della tutela del territorio 8 maggio 2003, n.203.
Norme affinché gli uffici pubblici e le società a prevalente capitale pubblico coprano il fabbisogno annuale di manufatti e beni con una quota di prodotti ottenuti da materiale riciclato nella misura non inferiore al 30% del fabbisogno medesimo.
Decreto emanato dal Ministro dell’ambiente e della tutela del territorio di concerto con il Ministro delle attività produttive e del Ministro della salute.

Acqua minerale
Decreto del Ministero della salute 11 settembre 2003
Attuazione della direttiva 2003/40/CE della Commissione nella parte relativa all'etichettatura delle acque minerali e delle acque di sorgente.
All'art. 1 sono specificate le indicazioni da porre in etichetta circa il contenuto di fluoro nelle acque minerali naturali a tutela in particolare dei lattanti e dei bambini d’età inferiore a sette anni. L'art. 2 riguarda l'etichettatura obbligatoria per il trattamento delle acque minerali naturali e delle acque di sorgente con aria arricchita d’ozono. La commercializzazione di acque minerali naturali e di acque di sorgente con etichette non conformi alle disposizioni del decreto è vietata dal 1 luglio 2004 (salvo deroga per esaurimento scorte precedenti).

Prodotti cosmetici
2003/80/CE: Direttiva della Commissione del 5 settembre 2003 che stabilisce all'allegato VIII bis della direttiva 76/768/CEE del Consiglio il simbolo indicante la durata d'idoneità all'impiego dei prodotti cosmetici.
Per i prodotti cosmetici per i quali la durata minima supera i trenta mesi va fornita un'indicazione concernente il periodo di tempo in cui il prodotto, una volta aperto, può essere utilizzato senza effetti nocivi per il consumatore.
A tale scopo l'articolo 6, paragrafo 1, lettera c), della direttiva 76/768/CEE del Consiglio prescrive l'impiego di un simbolo seguito dall'indicazione del periodo d'idoneità all'impiego (espresso in mesi e/o anni).
La direttiva in esame completa con il simbolo ed il testo quanto prescritto dalla direttiva 76/768.

Collagene
2003/721/CE: Decisione della Commissione del 29 settembre 2003 recante modifica della direttiva 92/118/CEE del Consiglio per quanto riguarda le condizioni per il collagene destinato al consumo umano e abrogazione della decisione 2003 /42/CE.
Come per le gelatine anche il collagene destinato al consumo umano segue la stessa disciplina in tema di condizioni sanitarie per il confezionamento, imballaggio, immagazzinaggio e trasportato.
Tali fasi devono essere eseguite in condizioni igieniche soddisfacenti, e in particolare deve essere previsto un locale per deposito, il confezionamento e l’imballaggio. Il confezionamento e l’imballaggio devono aver luogo in locali e superfici adibite a questo specifico scopo.
Le confezioni e gli imballaggi contenenti collagene devono recare un marchio d’identificazione in cui risulti nome o sigla del paese speditore seguiti dal numero di registrazione dello stabilimento. Devono inoltre recare la dicitura “Collagene destinato al consumo umano”.

Additivi alimentazione animale
Regolamento (CE) n. 1831/2003 del Parlamento europeo e del Consiglio, del 22 settembre 2003, sugli additivi destinati all'alimentazione animale.
Scopo del presente regolamento è istituire una procedura comunitaria per l'autorizzazione all'immissione sul mercato e all'utilizzazione degli additivi per mangimi, nonché introdurre norme per il controllo e l'etichettatura degli additivi e delle premiscele di additivi per mangimi.
Di conseguenza nessuno può immettere sul mercato un additivo per mangimi, o una premiscela di additivi, se il suo imballaggio o contenitore non è etichettato sotto la responsabilità di un produttore o di un responsabile del confezionamento o di un importatore o di un venditore o di un distributore stabilito all'interno della Comunità e non reca, in modo chiaramente visibile e indelebile, redatte almeno nella lingua o nelle lingue nazionali dello Stato membro in cui è commercializzato, una serie d’informazioni quali ad esempio: il nome specifico dato agli additivi nell'autorizzazione; il peso netto o, per gli additivi liquidi e le premiscele liquide, il volume netto oppure il peso netto; istruzioni per l'uso, raccomandazioni concernenti la sicurezza d'impiego; ecc
